This document governs the use of the Maison Noire website (the “Platform”) and sets out the conditions under which personal data is processed. Maison Noire operates a curated editorial platform. It is not a marketplace, directory, intermediary, agent, or employer.

2. Scope of Application
These Terms and Conditions apply to any visitor, subscriber, or user of the Platform (the “User”). By accessing the Platform, the User acknowledges having read and accepted these Terms without reservation.
Maison Noire reserves the right to amend these Terms at any time. The version published on the Platform at the time of access is the applicable version.
3. Nature of the Platform
Maison Noire provides editorial content, curatorial information, and contextual material relating to its House and its muses. No outcomes, services, or engagements are guaranteed. Maison Noire does not act as an employer, agent, or intermediary.
Any cooperation between visitors and muses occurs outside the Platform and under separate agreements.
4. Intellectual Property Rights
The entire content of the Platform, including but not limited to texts, graphics, photographs, images, videos, logos, icons, layout, structure, databases, source code, and design elements, is the exclusive intellectual property of the Administrator or its licensors.
The Platform and its contents are protected by Belgian copyright law, European copyright directives, and the Belgian Law of 31 August 1998 on the legal protection of databases (transposition of Directive 96/9/EC).
Any reproduction, extraction, adaptation, translation, modification, distribution, communication to the public, or reuse of all or part of the Platform, whether qualitative or quantitative, by any means and in any form, is strictly prohibited without the prior written consent of the Administrator.
Infringement of these rights may give rise to civil and criminal liability, including fines of up to €25,000 in accordance with applicable law.
5. Limited License of Use
The Administrator grants the User a non-exclusive, non-transferable, revocable license to access and consult the Platform for personal and non-commercial use only.
The User may download or print content solely for private consultation, provided that the content is not modified and that all intellectual property notices are retained.
Any commercial use is strictly prohibited.
6. Hyperlinks
Unless explicitly refused, the creation of a hyperlink to the homepage of the Platform is permitted.
Deep linking to internal pages, framing, or embedding of the Platform within another website is prohibited without the prior written consent of the Administrator.
7. Liability
The Administrator cannot be held liable for:

any direct or indirect damage resulting from access to or use of the Platform;

interruptions, errors, viruses, or technical malfunctions;

external actions, including unauthorized copying or misuse of content by third parties.
The Administrator cannot be held responsible for claims brought by third parties alleging infringement of their rights due to content displayed on the Platform, unless mandated by law.
8. Prohibited Use and Minors
Access to the Platform is strictly limited to persons aged 18 or older.
Any attempt to access, use, or interact with the Platform by minors is prohibited.
Any unlawful, abusive, misleading, or infringing use of the Platform is strictly forbidden.
9. Personal Data Processing
Maison Noire processes personal data in accordance with the General Data Protection Regulation (GDPR – Regulation (EU) 2016/679) and Belgian data protection law.
The Platform does not provide a contact form.
Personal data is collected exclusively via:

direct email correspondence initiated by the User.
10. Purpose of Processing
Personal data is processed solely for:

managing subscriptions;

sending editorial or informational communications;

responding to inquiries initiated by the User;

Data is not sold, rented, or shared for commercial purposes.
11. Data Retention
Personal data is retained only for as long as necessary to fulfill the purposes for which it was collected, or as required by legal obligations.
Users may unsubscribe at any time.
12. Data Security and Breach
The Administrator implements appropriate technical and organizational measures to protect personal data against loss, unauthorized access, alteration, or disclosure.
In the event of a personal data breach, the Administrator will comply with its obligations under GDPR, including notification to the relevant supervisory authority and affected users where legally required.
However, the Administrator cannot be held liable for damages resulting from breaches caused by external attacks beyond reasonable control.
13. User Rights
In accordance with GDPR, Users have the right to:

14. Governing Law and Jurisdiction
These Terms and this Privacy Policy are governed by Belgian law.
Any dispute relating to the Platform shall fall under the exclusive jurisdiction of the courts of Antwerp, Belgium.
